Beta Terms of Use

These terms govern the invitation-only PLOTPLUME STUDIO beta operated by Gil Naparstak for adult testers in Israel and the United States.

1.Operator and eligibility

PLOTPLUME STUDIO, formerly presented as WITNESS STUDIO, is currently operated by Gil Naparstak as an individual in Israel (“PLOTPLUME STUDIO,” “we,” or “us”), not by a company.

You may use this closed beta only if you are invited, are at least 18 years old, are located in Israel or the United States, can enter a binding agreement and comply with these Terms. Access is personal and may not be transferred.

2.Acceptance and beta status

By checking the acceptance boxes and entering the beta, you agree to these Terms and acknowledge the Privacy Notice. If you do not agree, do not use the beta.

The service is experimental, unfinished and supplied for evaluation. Features, formats, limits and availability may change, fail or be withdrawn. Do not rely on the beta as the only copy of important work or for time-critical commercial production.

3.Accounts and access

You are responsible for keeping your sign-in method, password and private invitation link secure, for activity under your identity and for promptly reporting suspected unauthorised access. Invitation links are personal, single-use and must not be forwarded. You must not bypass limits, access another user’s data, test security without written permission or interfere with the service.

4.Your content

You retain ownership of content you submit. You grant the Operator a limited, non-exclusive, worldwide licence to host, copy, process, transmit and display that content only as reasonably necessary to provide, secure, troubleshoot and improve the beta and to comply with law.

You represent that you have the rights and permissions needed for everything you upload and for our limited processing of it. Do not submit unlawful, infringing, deceptive or malicious material; trade secrets you are not authorised to disclose; highly sensitive personal information; or personal information or media of minors without all required authority.

5.Creative and AI-assisted material

The beta helps organise creative decisions and may prepare prompts or material for tools chosen by the user. Outputs, suggestions and production material require human review. We do not guarantee accuracy, originality, continuity, legal clearance, non-infringement or acceptance by any third-party AI or production service. You are responsible for reviewing and clearing final use.

6.Acceptable use

  • Do not violate law, privacy, publicity, intellectual-property or contractual rights.
  • Do not impersonate others, distribute malware, scrape the service or attempt to discover another user’s content.
  • Do not use the beta to create or distribute exploitative, abusive or non-consensual intimate material.
  • Do not resell access or use automated traffic that burdens or evades beta limits.

7.Privacy and confidentiality

Our collection and handling of personal information is described in the Privacy Notice. The beta is designed to separate signed-in users’ projects, but no online system provides an absolute guarantee of confidentiality or security.

Beta screens, unreleased features and non-public operational information should be treated as confidential unless we make them public or give permission to share them.

8.No payments during this beta

No payment method is connected and no fee is charged for the current closed beta. Displayed prices describe possible future plans only. Any paid launch will require separate, clear commercial terms before a charge is made.

9.Our materials

Except for your content, the service, interface, branding, software and original materials belong to the Operator or applicable licensors. These Terms give you only a limited, revocable, non-transferable right to use the beta for its intended evaluation purpose.

10.Suspension and ending access

You may stop using the beta and use the account-deletion control at any time. We may suspend or end access to protect the service or users, investigate misuse, comply with law, enforce these Terms or discontinue the beta. Where reasonably possible, we will allow an opportunity to export a readable report before a planned discontinuation.

Sections that by their nature should continue—including ownership, disclaimers, liability limits and dispute terms—survive termination.

11.Disclaimers

To the maximum extent permitted by applicable law, the beta is provided “as is” and “as available,” without warranties of uninterrupted operation, fitness for a particular purpose, merchantability, non-infringement, data preservation or production results. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

12.Limitation of liability

To the maximum extent permitted by applicable law, the Operator will not be liable for indirect, incidental, special, punitive or consequential loss; loss of profits, opportunity, reputation or data; or the cost of substitute production services arising from the beta.

To the maximum extent permitted, aggregate liability arising from the beta will not exceed US $100. This limit does not apply to liability that cannot legally be limited, including where applicable liability for fraud, wilful misconduct or personal injury caused by negligence. Mandatory consumer rights remain unaffected.

13.Responsibility for misuse

To the extent permitted by law, you will be responsible for third-party claims and reasonable costs arising directly from content you submit, your unlawful use of the beta or your material breach of these Terms, except to the extent caused by the Operator’s own breach or misconduct.

14.Governing law and disputes

These Terms are governed by the laws of Israel, without regard to conflict-of-law rules, and disputes will be submitted to the competent courts in Tel Aviv–Jaffa, Israel. If you are a consumer in the United States, this clause does not remove non-waivable rights or protections available under applicable federal or state law.

15.Changes and general terms

We may update these Terms as the beta changes. Material updates may require fresh acceptance. If you do not accept an update, stop using the beta.

If one provision is unenforceable, the remainder continues to apply. A failure to enforce a provision is not a waiver. These Terms and the Privacy Notice are the entire beta agreement. You may not assign beta access; the Operator may transfer the service and this agreement as part of a future business organisation or transaction, subject to applicable law.
